5.6.2 Non-discrimination policies for transgender individuals
Srinakharinwirot University's "Declaration of Intent to Promote Equality and Eliminate Unfair Discrimination between Genders" includes robust non-discrimination policies that specifically extend to transgender individuals. The policy demonstrates a commitment to recognizing and respecting gender diversity beyond binary sex classifications, evident in several key points:
Explicit Recognition of Gender Diversity (Gender Identity/Expression) (Point 1): The policy explicitly states that it will not engage in "unfair discrimination against individuals due to differences in sex or gender diversity (gender identity/expression)." It also condemns acts that "depreciate an individual's worth because of sex, gender (gender identity), or sexual orientation." This language directly covers transgender individuals and their gender identities.
Inclusive Dress Code (Point 2): This point is particularly significant for transgender individuals, allowing "Personnel and students [to] dress according to their gender identity or gender expression, in accordance with the regulations of Srinakharinwirot University." This directly addresses a common area of discrimination and affirms the right of transgender individuals to express their gender authentically within the university's dress code.
Non-Discrimination in Activities and Applications (Points 3 & 4):
Activities (Point 3): The policy ensures that students (including transgender students) can participate in "various student activities... equally, equitably, and without unfair discrimination between genders," with sensible exceptions for gender safety or specific requirements.
Application Announcements (Point 4): It clearly states that "gender-specific characteristics, gender (gender identity/expression), or sexual orientation" will not be used as qualifications or disqualifications for any applications, reinforcing fair access for transgender individuals.
Inclusive Representation in Leadership (Point 5): The policy promotes the recruitment of individuals who "express themselves differently from their assigned sex at birth" (ผู้แสดงออกที่แตกต่างจากเพศโดยกำเนิด) to participate in committees and positions at all levels, equally and equitably. This directly encourages the inclusion and leadership of transgender individuals.
Prevention of Harassment (Point 1 & 6): The policy aims to "refrain from any acts of sexual harassment... as well as any acts of bullying, contempt, humiliation, oppression, intimidation, or depreciation of an individual's worth because of sex, gender, or sexual orientation" (Point 1). This is further strengthened by establishing "mechanisms and processes to prevent and resolve issues of unfair discrimination between genders, and sexual harassment or intimidation in the workplace" (Point 6). These measures are crucial for protecting transgender individuals from harassment and creating a safe environment.
In conclusion, Srinakharinwirot University's Declaration of Intent goes beyond a general non-discrimination stance to specifically include and protect transgender individuals. It addresses key aspects like gender identity/expression, dress code, participation, recruitment, and protection from harassment, thereby demonstrating a strong commitment to fostering an inclusive and equitable environment for transgender members of its community.
